The legal department is an integral part of our collection process. It accounts for as much as 60% of our recovery and makes us more effective than other companies which do not litigate. Even though the costs have become quite high, in today's market it is a necessity to file legal suits. Debtors have become more sophisticated, present laws have become prohibitive in their complexity; information services and the internet provide consumers with some information of valid content, and more information of miswritten or misinterpreted origin. All of which, valid or invalid, hinders the collection process.
During our legal process, our legal department considers each debtors rights before taking any action. Our legal department collectors contact debtors at each phase of the legal process, from the initial Notice to the final Levy. We offer opportunities to make restitution or settle the accounts, when possible, hoping to avoid the need for court or post-judgment procedures. This not only encourages a faster return but also allows the debtor the opportunity to protect his position, and save some money in the process.
In too many situations, regardless of our FDCPA approved notices, letters, and phone calls, it seems to be a growing tendency that only when the debtor receives the lawsuit papers do they realize we are serious about collecting the debt. The lawsuit seems to get their attention more than any other procedure. If the debtor moves out of state before we can file our suit, or before the judgment is entered, we refer the account to a reliable attorney in the debtor's area with no additional cost to our client . Our on-staff attorneys handle all of our collection legal matters in the state of California. We contract with outside attorneys when and if necessary.
PRE-LEGAL DIVISION:
Our Pre-Legal Division is the first step for every potential lawsuit. If we are unable to encourage payment using our initial collection procedures, accounts receive a thorough pre-legal screening. The account is not being sued at this step until all the proper assets can be verified to insure an equitable return and justifiable legal action. Once we know we can proceed with legal action, V.I.P. will then submit a request for authorization to proceed to the assigning client or account owner, unless other instructions are already in our possession.
LEGAL PROCESSING:
If negotiated and agreed to in our Collection Agreement, V.I.P. advances court costs for our clients as needed and recovers those costs out of first collections received after the court judgment has been awarded. Due to the high cost of filing legal actions in California, V.I.P. will only advance costs for cases that our investigation has shown to have all the proper assets for a satisfactory recovery. Should our client wish suits filed on a broader spectrum, we invite our client to advance filing costs for the additional actions.
V.I.P. works closely with clients to ensure particular needs are met and informed as to progress on any legal matter. Our office handles all of the details. SUPERIOR COURT filings are handled by our legal department and filed in the name of V.I.P. ADJUSTMENT BUREAU, INC. by our client's assignment. SMALL CLAIMS filings are always filed in the name of our client. Should our client wish a different disposition for court filing, we are happy to discuss all possibilities at the time our Collection Agreement is negotiated.
Substitutions, Arbitration Forms and Satisfactions are prepared by our legal department and filed with the court as needed on all cases that we have initiated.
V.I.P. ADJUSTMENT BUREAU, INC. actively pursues pre- and post-judgment remedies. With our client's approval, we will not hesitate to proceed with judgment enforcement. V.I.P. ADJUSTMENT BUREAU, INC. will garnish wages, attach accounts, repossess, order debtor / judgment hearings, hire “till-taps” or officers to collect from businesses on site, and, work entirely within the limits the law allows. Above all, we keep the integrity of our clients, and the rights of the debtors paramount as a governing cause, shaping all of our departmental actions.
